Terms of service
Scope
These terms govern every transport, warehousing and intermodal service provided by Translog SAS. They apply unless a signed framework agreement says otherwise, in which case that agreement prevails on the points it covers.
International road movements are additionally governed by the CMR Convention, which takes precedence over any conflicting clause below.
Quotes and orders
A quote is valid for thirty days and is based on the information you supply: origin, destination, volume or weight, equipment type and receiving hours. If any of those change, the rate is requoted before the movement runs — never after it has been delivered.
An order is formed when we confirm a collection window in writing. A booking without a confirmed window is a request, not a commitment.
The goods
You warrant that the goods are correctly described, lawfully transportable, and packed to withstand normal carriage. Dangerous goods must be declared before booking, with the correct classification and documentation; undeclared dangerous goods will be refused at collection and charged as a cancelled movement.
We do not carry cash, precious metals, live animals, human remains, or goods whose carriage requires a licence we do not hold.
Collection and delivery
Transit times are commitments on contracted lanes and estimates on spot movements, in both cases subject to circumstances outside our control: border controls, weather, strike action, or a receiving site that refuses the vehicle within its stated hours.
Waiting time beyond the agreed free period at collection or delivery is charged at the rate stated in the quote. We will always call you before the free period expires.
Delivery is complete when the goods are handed over at the agreed address and the proof of delivery is recorded. Where nobody is present to receive them, the goods return to the nearest hub and re-delivery is charged.
Liability and insurance
Our liability for loss of or damage to goods is limited to the ceiling set by the CMR Convention for international movements, and by the applicable national contract for domestic ones.
Where the value of the load exceeds that ceiling, ad valorem cover is available on request and quoted as a separate line before the movement runs. Without it, the statutory limit applies whatever the declared value.
We are not liable for indirect or consequential loss, including loss of profit, loss of production or contractual penalties owed by you to a third party.
Claims
Visible damage or shortage must be noted on the delivery document at the moment of handover. Concealed damage must be notified in writing within seven days of delivery. Claims raised outside those windows cannot be pursued against the carrier.
Send claims to contact@translog.eu with the movement reference, the delivery document and photographs of the goods as received.
Payment
Spot movements are payable within thirty days of invoice; contracted lanes within forty-five days, unless the framework agreement says otherwise. Late payment carries interest at the statutory rate plus the fixed recovery indemnity provided by French law.
Fuel indexation, where agreed, is applied prospectively against a published index. It is never applied retroactively to movements already delivered.
Cancellation
A spot movement can be cancelled free of charge until the vehicle is assigned, which is normally the evening before collection. After assignment, a cancellation charge covers the driver hours and positioning already committed.
Contracted lanes carry the notice period set in the agreement.
Governing law
These terms are governed by French law. Disputes fall to the commercial court with jurisdiction over our registered office in Rennes, without prejudice to the mandatory jurisdiction rules of the CMR Convention for international carriage.
